My sister and my niece are dead and I have been wrongfully convicted of their murders.
My sister's murder conviction against me was dismissed in appeal court.
I need help proving my innocence of my niece's murder.
* The confessed murderers of my sister made plea bargains in return for their
testimonies.
* The prosecution agreed to drop the first degree murder charge against them and
allow them to plead to second degree murder for the murder of my sister.
* The State dropped the first degree murder charge of my niece and allowed one
of her killers to plead to two accounts of accessory after the fact and one count
of permitting a child to be abused.
Crime Facts
My older sister and her 11 year old daughter were murdered in Sept. 1991 by my ex-wives
acting together. The crimes were unsolved until August 1994 when Juanita Cummings, my ex-wife, confessed to the Sheriff's Dept to shooting dead my sister, Judy Ann Moody Mayo.
Juanita was charged with first degree murder of my niece, Melissa Marie Moody.
Sherry Cummings was charged with first degree murder of Judy.
I was charged with 2 counts of first degree murder, acting in concert with the two women.
Both women admitted to killing my sister while I was out of town. Because of the inconsistent and conflicting testimonies of the women, it's unclear what happened or where the murders were committed. Yet it was undisputed in court that I was 100 miles away when my sister Judy was murdered. I was with my father (now deceased) who was admitted to hospital for cancer tests.
The evidence at trial showed that I had no motive to want either Judy or Melissa dead
that I was on good terms with them both.
Important evidence which would have impeached the women and their claims was not
presented at trial. Jurors were unaware that Sherry and Juanita had incentives to frame me.
Juanita and Sherry entered into plea agreements with the state in exchange for the testimony
as state witnesses. In return for Juanita's testimony, the prosecution agreed to drop the first degree murder charge against her and allow her to plead to second degree murder with a recommended sentence of life imprisonment.
The State agreed to drop the first degree murder charge against Sherry in return for her testimony. Sherry was to be allowed to plead to two accounts of accessory after the fact and one count of permitting a child to be abused, with a sentence totalling 35 years imprisonment.
