Dear Friends,
My name is Edgar Tamayo #999130, age 38 (Oct. 22, 1967), born in Mexico, Cuernavaca, Morelos. Mexico. And I am bilingual, catholic and my pass time is writing and reading and work out everyday...
     Mostly, I try to work on my case so I can help my lawyer. The reason why I am writing this letter is to tell the following:
     I'm in the United States on Death Row in Texas, a state which leads the nation in executions. I was convicted in 1994 for one accident! Yes, I say accident because when this accident happened, I am under the influence and when I wake up, I am in jail with a Capital Murder case!! And I don't even remember how this accident happened an I have maintained my Innocence from day one! Of course, these people (D.A.) do not even have my fingerprints... and I am on Death Row...for 12 long years...
    Through a series of illegal maneuvres by the police and the prosecutors D.A. (and my own lawyer knows and he don't do nothing), such as the use to manufactured, falsified documents and false witnesses and perjured testimony, I was not able to hire an attorney to defend me at trial becuase I am poor and a mexican!!
     Therefore I was given a court appointed attorney it is commonly know that defendants with court appointed attorneys are at least ten times more likely to be convicted! Because such attorneys are only permitted $500.00 for investigations, lab. analisis and expert witnesses and that's why the lawyers do not wanna do nothing! Becuase they don't want to spend the money!! And we pay with our life!!
     While the state has unlimited resources to seek a conviction, having already been at a disadvantage, my cour appointed attorney failed to provide me with the effective assistance of counsel, that every defendant is entitled to under U.S. Constitution. The attorney failed to properly investigate my case and did not present rebuttal evidence that was available. He failed to impeach at least two state witnesses and counsel failed to vigorously persue these matters in cross examinations of the witnesses.
     Also when I got under arrest the police, prosecutors and my own lawyer violated my right about the Vienna Convention. They know that I'm a mexican citizen and I have my rights to speak first with the mexican cousulate, and I never did!!
      Now, about my case. I am waiting for the courts to rule on my Federal Habeas. If my case is not reversed, I'm going to be forced to prove my innocence to correct this miscarriage of justice. This can only be accomplished if I'm able to hire a good investigator, expert witnesses and if possible an attorney of my choice to defend me when the state takes me to trial again (if I get a new trial). I pray to God that the court will do the correct thing and overturn my conviction.
